Terms of Service for Recurring Payment Service – v1

Acknowledgment

These terms and conditions are established to define the rights, obligations, and responsibilities of the website and users in relation to the recurring payment services (hereinafter referred to as the Service) provided by the solved.ac website (hereinafter referred to as solved.ac) operated by Solved Company (hereinafter referred to as the Company) is intended to define.

Definitions

For these Terms and Conditions:

  1. Member means a person who can continue to use the Service provided by the Company by accessing it under these terms and conditions.
  2. Recurring Payment Service refers to the convenience service where the service fee for the Company's service period is automatically charged on the payment date designated by the Company using the card information registered by the Member.

The meaning of the provisions of this clause, which are not defined herein, is faithful to the norm.

Application and Amendment of Terms and Conditions

  1. These terms and conditions take effect when a Member who wishes to pay the recurring service fee by automatic recurring payment agrees to these terms and conditions.
  2. The Company shall post these terms and conditions on the initial service screen of solved.ac so that Members can easily check their contents. However, specific details of the terms and conditions may be viewed through a linked screen.
  3. The Company may amend these terms and conditions to the extent that it does not violate related laws of the Republic of Korea, such as the ACT ON THE CONSUMER PROTECTION IN ELECTRONIC COMMERCE, ETC., THE ACT ON THE REGULATION OF TERMS AND CONDITIONS, THE FRAMEWORK ACT ON ELECTRONIC DOCUMENTS AND TRANSACTIONS, THE ELECTRONIC FINANCIAL TRANSACTION ACT, THE ELECTRONIC SIGNATURE ACT, THE ACT ON PROMOTION OF INFORMATION AND COMMUNICATIONS NETWORK UTILIZATION AND DATA PROTECTION, ETC., and THE FRAMEWORK ACT ON CONSUMERS.
  4. If the Company revises the terms and conditions, the Company has to specify the date of application and the reason for the revision and display the current terms and conditions on the page of the Service seven days (30 days if the change is unfavorable to members) before the effective date.
  5. The terms and conditions changed under Paragraph 4 shall not be applied retroactively before the effective date unless there are special regulations or other unavoidable reasons in the relevant laws and regulations.
  6. If the Member does not explicitly express their intention to refuse after the effective date notified under paragraph 4, it is deemed to have agreed to the revised terms and conditions. Members who disagree with the changed terms and conditions may request membership withdrawal.
  7. Despite the measures in Paragraph 4, the Company is not responsible for damages caused by members not knowing the amendment of the terms and conditions.

Provision Conditions of Recurring Payment Service

  1. The recurring payment service cannot be provided to minors without the consent of a guardian or legal representative. If a minor wishes to use the recurring payment service, they must obtain consent from a guardian or legal representative.
  2. When a minor uses the recurring payment service, consent from a guardian or legal representative is considered to have been obtained.

Registration, Renewal, and Restriction of Recurring Payment Service

  1. The application for using the recurring payment service is established when a Member expresses intent to agree to these terms and conditions and applies for use, and the Company approves it.
  2. For the application according to paragraph 1, if necessary for service use, the Company may request identity verification through a professional agency, such as mobile phone number verification.
  3. The Company may defer the approval of the application for the recurring payment service for a certain period to determine the Member's eligibility for the service.
  4. The start date of the recurring payment service is when the Company approves the registration based on the Member's application.
  5. Upon completing the registration according to paragraph 4, a contract for the recurring payment service is established between the Company and the Member, and the Member can use the recurring payment service under these terms and conditions.
  6. The Company may refuse or defer the approval of the application or reapplication for the recurring payment service if the following reasons arise. The Company is not responsible for damages incurred by Members due to refusal or deferral of registration.
  1. The contract period of this agreement is specified separately by the Company.
  2. This contract is automatically renewed under the same conditions and contents for the same period each time the contract period expires, and the same applies thereafter.

Payment Method

The payment method for the recurring payment service purchased from the Company can be made using the following methods. However, the Company cannot charge any additional fees for the user's payment method.

Suspension of Recurring Payment Service

  1. The Company may temporarily suspend the provision of the recurring payment service due to reasons such as natural disasters or equivalent force majeure, maintenance, inspection, replacement, breakdown, or interruption of information and communication facilities such as computers.
  2. The Company compensates for damages incurred by Members due to the temporary suspension of the recurring payment service for reasons in paragraph 1. However, this does not apply if the Company proves there was no intention or negligence.

Fees and Payment

  1. The service fee for one month or one year of the service used by the Member according to the recurring payment service is automatically charged on the date designated by the Company and paid to the Company using the payment method designated by the Company. If this contract is renewed based on paragraph 8 of Article 5, the basic fee is automatically charged using the payment method designated by the Company.
  2. The recurring payment service continues to charge the service fee regularly during the usage period regardless of the Member's actual usage. Therefore, Members who wish to cancel the recurring payment service must express their intent to cancel to the Company.

Termination of This Agreement

  1. Members may request to terminate this agreement at any time using the method provided by the Company. (Settings > Pro > Cancel Recurring Payment) Even if terminated, the amount corresponding to the service usage days is not refunded, and the recurring payment service can be used until the expiration of the usage period.
  2. If a Member falls under any of the following reasons, the Company may terminate this agreement with the Member. The Company is not responsible for damages incurred by Members due to termination for the following reasons.
  1. If the Company terminates the service use agreement according to paragraph 2, it shall notify the Member of the reason and the restriction period.
  2. Members may file an objection regarding the usage restrictions under this article following the procedures set by the Company. If the Company deems the objection justified, it will immediately resume the use of the service.

Mid-Term Cancellation of Recurring Payment Service

  1. Members using the automatic payment service may apply for mid-term cancellation of the recurring payment service within 7 days from the purchase date through the email address provided by the Company.
  2. If a Member applies for mid-term cancellation, they can receive a refund of the amount after deducting the amount corresponding to the usage days from the cancellation date.

Company Obligations

  1. The Company does not do anything prohibited by these terms and conditions or against public order and morals. It does its best to provide services continuously and reliably as stipulated in these terms and conditions.
  2. The Company must have a security system to protect Members' personal information so Members can use the Service safely and disclose and comply with the privacy policy.

Membership Obligations

  1. Members shall enter the most recent actual information required by the Company following the procedures for applying for the recurring payment service.
  2. Members shall use their payment methods for using the recurring payment service.
  3. Members shall comply with these terms and conditions and actively cooperate with the Company to provide services normally.

Disclaimer

  1. The Company is exempted from responsibility for providing services if it cannot provide services due to natural disasters or equivalent force majeure.
  2. The Company is not responsible for any obstacles in using the Service for reasons attributable to the Member.

Resolution of Disputes

  1. The Company is not responsible for any obstacles in using the Service for reasons attributable to the Member.
  2. The Company does not take any responsibility for disputes arising from problems other than the services provided to users.

Jurisdiction and Governing Law

  1. The laws of the Republic of Korea apply to the interpretation of these terms and conditions and disputes between the Company and the Members.
  2. In case of a dispute arising between the Company and the Member concerning these terms and conditions and the use of the Service, the competent court shall be determined under the CIVIL PROCEDURE ACT.

Addendum

These Terms and Conditions apply from July 9, 2024.

If the interpretation of the terms and conditions differs between English and Korean, the interpretation of the Korean Content shall prevail.
